Patricia J. Foltz was admitted to the Bars of Illinois and the U.S. District Court, Northern District of Illinois in 1982 and is a member of the Federal Trial Bar. Ms. Foltz is an experienced trial attorney who counsels clients on a variety of regulatory and patient care issues. She assists hospitals and individual practitioners with issues related to patient information disclosure, consent for treatment, advance directives, quality assurance/peer review (including maintaining privilege on those activities), risk management, HIPAA, EMTALA, licensure, religious objection to treatment, end of life issues, mental health and issues related to human research. She has represented several hospitals in threatened termination of their Medicare provider status for alleged non-compliance with Medicare conditions of participation. Born in Philadelphia, Pennsylvania, Ms. Foltz earned her B.S. in Biology from Antioch College in 1976 and her J.D., summa cum laude, from DePaul University College of Law in 1982. Ms. Foltz is a member of the American Health Lawyers Association and the Illinois Association of Hospital Attorneys. She served as Associate General Counsel at Michael Reese Hospital and Medical Center for over two years, was a member of the Michael Reese Institutional Review Board and the Ethics Committee at Mt. Sinai Hospital. She is a frequent lecturer on issues including: Special Problems in Institutional Negligence; EMTALA/anti-dumping; Confidentiality; Consent and Advance Directives; Privilege under the Medical Studies Act; Issues in Mental Health and Health Insurance Portability and Accountability Act (HIPAA). She and Mr. Parson recently authored a chapter on EMTALA in the CCH Healthcare Compliance Professional’s Manual. |
