Illinois now has formal procedures for release of decedent's records

Our governor recently signed into law a statutory provision that sets out a procedure for a relative of a deceased patient to obtain medical records where there is neither a power of attorney in place nor an administrator of the decedent's estate.  A link to the copy of the Public Act is below.  We now have a formal procedure for handling a situation that was legally undefined in the past.  This procedure applies to both corporate and individual providers.  You will need to work with your medical records department to put this procedure in place.  If you have any questions feel free to contact Patricia Foltz at 312-673-7805 or patricia.foltz@arandpartners.com.
